PROPOSED VARIATION TO THE USED PACKAGING MATERIALS NEPM

The purpose of this proposed variation to the Used Packaging Materials NEPM is to extend its life to 2010 in order to support the National Packaging Covenant.

The goal of the Used Packaging Materials NEPM is to reduce environmental degradation arising from the disposal of used packaging and conserve virgin materials through the encouragement of re-use and recycling of used packaging materials by supporting and complementing the voluntary strategies in the National Packaging Covenant.

The Covenant, an industry self-regulatory instrument, aims to ensure that all involved in the packaging chain play their part in reducing packaging waste. The NEPM ensures that participants in the Covenant are not unfairly disadvantaged in the market place.

In July 2004, the National Environment Protection Council made a minor variation to the Used Packaging Materials NEPM. This minor variation extended the life of the NEPM as the regulatory safety net underpinning the National Packaging Covenant for twelve months to 14 July 2005.

As indicated above, a further variation to the NEPM is required to extend it to 2010. The draft variation will ensure consistency between the NEPM and the strengthened National Packaging Covenant and provide for the continuation of an effective co-regulatory arrangement in relation to the management of consumer packaging and consumer paper for the life of the Covenant.

Documents relating to the proposed variation which were released for public consultation, can be downloaded below. These are:

  • Draft Variation to the Used Packaging Materials NEPM
  • Draft Variation to the Used Packaging Materials NEPM – Proposed Amendments (a version of the NEPM with the proposed changes highlighted for ease of interpretation
  • Draft Variation to the Used Packaging Materials NEPM – Explanatory Notes (a summary of the more significant changes to the NEPM)
  • Draft Variation to the Used Packaging Materials NEPM - Impact Statement
  • Impact Statement for the Draft National Environment Protection Measure for Used Packaging Materials January 1999 (as material from the original 1999 impact statement is still relevant and referred to in the current Impact Statement, all relevant documents have been made accessible together for ease of reference).

In assessing the impacts of the proposed NEPM variation, the NEPM Impact Statement acknowledges that the Covenant and the NEPM are an integral package and that the role of the NEPM has been taken into account in the development of the Regulatory Impact Statement (RIS) for the Covenant. Consequently, the NEPM variation documents should be read in conjunction with the strengthened Covenant and its associated RIS. Click here to access the Covenant and RIS.

The submission period on the draft NEPM Variation and Impact Statement has closed.
