USED PACKAGING MATERIALS NEPM

The goal of the Used Packaging Materials NEPM is to reduce environmental degradation arising from the disposal of used packaging and conserve virgin materials through the encouragement of re-use and recycling of used packaging materials by supporting and complementing the voluntary strategies in the National Packaging Covenant.

The Covenant, an industry self-regulatory instrument, aims to ensure that all involved in the packaging chain play their part in reducing packaging waste. The NEPM ensures that participants in the Covenant are not unfairly disadvantaged in the market place.

The Covenant was extensively reviewed in 2004 and revised in response to the findings of the evaluations. After further public consultation a new, strengthened Covenant was released in July 2005. The new version of the Covenant incorporates changes to achieve substantially improved performance.

In July 2005, the NEPC made a variation to the NEPM to extend it to 2010. The variation will ensure consistency between the NEPM and the strengthened National Packaging Covenant and provide for the continuation of an effective co-regulatory arrangement in relation to the management of consumer packaging and consumer paper for the life of the Covenant.

NATIONAL PACKAGING COVENANT
AND COMPLEMENTARY ECONOMIC MECHANISMS STUDY

The National Packaging Covenant provides for a mid-term review of the Covenant, which expires in 2010, to be undertaken by 31 December 2008. The National Packaging Covenant Council has agreed that the review be completed for presentation to the Environment Protection and Heritage Council (EPHC) at its November 2008 meeting.

EPHC also directed that work on complementary economic mechanisms be undertaken. The purpose of this work was to identify and assess other economic instruments that might be complementary to the objectives of the Covenant and assist in achieving the performance targets established under the current Covenant, such instruments to be available should the mid-term review show the Covenant will fail to deliver satisfactory outcomes.

The mechanisms identified through this work could also inform EPHC in the development of future Covenants, or in any review of the balance and relationships between the regulatory, economic and voluntary mechanisms for achieving packaging targets.

Potential mechanisms are identified in the report National Packaging Covenant Complementary Economic Mechanisms Investigation prepared by McLennan Magasanik Associates Pty Ltd in conjunction with the BDA Group.
